Is This People over Politics? Part 2

upsidedownjusticeAs I had anticipated and wrote in my previous posting “Johnson and Johnson and the Nassau Democrats have a simple game plan - invalidate the legitimate candidacy of a Citizen in favor of the party’s insider nominee”.  The Plan, executed in the courtroom of Judge Dana Winslow on August 10, 2010 worked flawlessly.  Judge Winslow invalidated the thousand plus signatures.  Here is the formula, which I call “How to Disenfranchise a Community” as executed by Senator Craig Johnson of the Johnson and Johnson and Nassau Democratic Machine:

First - remove professional legal representation from the Citizen.  Nicolosi’s attorney is forced to recuse himself because when he collected signatures in front of a CVS in Elmont he did not require each of the 120 signers to raise their right hand and swear or affirm their signature.  Ridiculous but true.  It is the letter of law though I suspect not the spirit of the law.  In addition they also get to throw all 120 signatures in a waste basket.

Secondly – counter sue.  Nicolosi gathers credible evidence of fraud, conspiracy to commit fraud and forgery.  He files a case.  The Johnson and Johnson and the Nassau Democrats immediately files a counter case.

Thirdly – have your case heard first.  Remember the plan “by invalidating Nicolosi’s candidacy Johnson and Johnson and the Democratic Party engine get to bury the real story, a story of prima fascia fraud, forgery and conspiracy to disenfranchise another community of color on Long Island.”  The two cases are consolidated before a single judge.  This seems on its face perfectly reasonable.  The judge then allows Johnson and Johnson and Nassau Democratic machine to present first with a stipulation that if they knock out Nicolosi’s signatures the case is closed and the real fraud, forgery etc. on the part of Johnson will not be heard (the “establishment” before “the people” theory).  Now, I have no evidence of this but it appears to the naked eye that being a senator is important in getting this First-Last Last-First thing to work.  How else can this be, email me if you have a theory or a fact?

Finally - backed by the letter of the law, enough money to pile 4 attorneys into the courtroom, a lawyerless, defenseless citizen and some legal maneuvering you move forward with the final crushing stomp on the neck of democracy.  Did you know private citizens (even the ones who represent themselves in court) do not have subpoena power?  When witnesses like Thelma Sardone, Gaspare Tuminello, Kerry and Jennifer Mavoroukas, and Mimi Pierre-Johnson ignored Nicolosi’s subpoenas they were within their rights because here again the judge explained that according to law private citizens do not have subpoena power.  This important fact and law allowed the aforementioned individuals to ignore Nicolosi’s request to have them testify.  Again using the “letter of the law” they all walked away from answering very important questions raised by both complaints.

In the end, as I watched with some disgust as the young attorney pranced around the courtroom, I realized I was watching an assisted suicide of democracy (Big D).  As I see it, this result is a loss for everyone.  Recall the way we Democrats feel when we hear the following words in the same sentence “Presidential Elections; George Bush; Supreme Court and Florida and four years later Ohio”.  Remember how we Democrats feel when we recall the hanging chad, or the Dade County ballots found in the dumpsters.  If that is too far south or west or ancient history, then remember how we felt here in Elmont during the School Board Election (Guibert v Ferrigno).  Our candidate lost by one vote and remember how we felt when with credible evidence of voter fraud the presently sitting VP of the Elmont School District got a free pass on responsibility and accountability.

In the end this is not about Nicolosi or Mimi Pierre-Johnson, this is about an idea I was willing to fight for as a US Marine – ‘Big D democracy’.  Johnson and Johnson and the Nassau Democrats should hang their heads in shame.

To Mimi and Pat, while this battle continues - I wonder “how does this benefit Elmont”? Shouldn't your energies go towards, "what are you going to do for Elmont"?

Please remember, "Elmont Voters" are smart, and diverse in thought. We cannot and will not be painted with one brush.

We understand that Excellence is the antidote to racism, sexism, classism...etc. So in short, we expect excellence from our candidates. Pointedly, we vote issues - not parties and certainly... not race. As a friend, both of you had better step up your games or else our votes will go elsewhere!!!

I don't know Mr. Nicolosi. Never met him. I have watched Craig Johnson and felt that there was something really wrong with how this guy works in Elmont. Roy Rambarran is right. As an african american I will not be duped by this guy anymore. Craig Johnson should resign as State Senator immediately. Anyone who would abuse his power like this is unfit for office. I will not allow my community to be treated like a ghetto like Craig Johnson continues to do. Democrats UNITE! Throw this bum out!

This story gets worse and worse.....

I found out today that the judge was actually going to put Mr Nicolosi on the ballot late yesterday afternoon until Craig Johnson's law firm filed a last minute objection to send the matter to a referee. This is UNCONSCIONABLE!!!!

How low will Craig Johnson stoop to defeat the will of the people of Elmont? This community has resoundingly rejected Mimi. Why won't he stop the legal obstructions, and at least allow us to have a choice?

Does Mimi realize she is simply being manipulated by Craig Johnson for votes?? It's obvious to me and everyone around me that Craig Johnson believes Mimi will get him the "black" vote in Elmont. Craig Johnson is in a tough race with Jack Martins and needs every vote he can get. He's not only using Mimi, but is using all the residents of Elmont in his attempt to get re-elected. I can't speak for Mimi, but I will not fall for this pathetic ploy. I'm not voting for Mimi, and I'm definitely not voting for Craig Johnson!

5th Precinct Update 3.27.2012

Legislator SolagesAfter the disastrous move by the County Executive and the Republican Majority to close half of the police precincts in Nassau County, the Democratic caucus was successful in pushing Ed Mangano's back against the wall so that he gave us a signed guarantee that there would not be one less patrol car in any neighborhood. The agreement additionally stated that there would be more law enforcement personnel in all of the policing centers.

As Newsday reported, “Democrats also demanded that the amount of borrowing be cut nearly in half from the $50 million requested by Mangano, saying the $26.5 million would cover the cost of officers expected to retire."

Senator MartinsLike many of you, I’m up early, reading the news and making breakfast before the rest of the family wakes up. Later, I manage to grab a few minutes to get ready between my wife and four children before embarking on daddy’s a.m. taxi service. This day, I’m a little late to an 8 a.m. meeting with union officials to discuss issues impacting them, but I’m sure I’ll make up the time somewhere in the day’s schedule.  By 9:30 a.m., I’m at a grammar school in another part of the district explaining how a bill becomes law to 200 fourth graders. They prove remarkably well-informed and pursue an analysis as to what recent legislation is likely to work and what they believe will not. I take mental notes.
